About Paint Element

Paint Element is operated by Paint Element Pty Ltd. These Terms of Service apply to your access to and use of the Paint Element website, platform, tools, subscriptions and related services.

Acceptance of terms

By creating an account, purchasing a subscription, or using the service, you agree to these Terms. If you do not agree, please do not use the service.

Use of the service

The service is provided to help users visualise paint colour options, manage paint-related project content, and access related tools. You agree to use the service only for lawful purposes and only with photos, information and materials you have the right to upload, use and modify.

Subscriptions and billing

Paint Element may be provided on a recurring subscription basis. By subscribing, you authorise Paint Element and its payment processor Stripe to charge your selected payment method for subscription fees, including recurring charges, until your subscription is cancelled.

Payment processing

Payments are processed securely by Stripe. Paint Element does not store complete payment card numbers or card security codes on its servers. By making a payment, you agree that your payment information may be collected and processed by Stripe in accordance with Stripe's applicable terms and privacy policy.

Cancellation

You may cancel your subscription at any time through your account settings or by contacting support. Cancellation prevents future subscription charges but does not automatically entitle you to a refund for subscription periods already billed.

Refund policy

Except where required by Australian Consumer Law, subscription fees are non-refundable once a billing cycle has commenced. Refund requests may be considered on a case-by-case basis.

Your content

You retain ownership of photos, project notes, colour selections and other content you upload. By uploading content, you grant Paint Element a limited licence to store, process, display and use that content as reasonably required to provide and improve the service. We do not claim ownership of your projects, uploaded photos, results or notes.

Acceptable use

You agree not to upload content that infringes another person's rights, contains personal information of third parties without consent, is misleading, harmful, unlawful, offensive, or otherwise inappropriate. We reserve the right to remove content and suspend access where these rules are breached.

Service availability

We strive to provide reliable access to the service, but we do not guarantee uninterrupted, error-free, or continuous availability. We may modify, suspend, restrict, or discontinue parts of the service at any time, including for maintenance, security, upgrades, or business reasons.

Repaint previews and results

Repaint previews, colour visualisations and related outputs are computer-generated approximations only. Actual painted results may vary based on lighting, surface texture, preparation, paint product, application method, screen settings and other conditions.

Disclaimers

The service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no warranties that the service will be error-free, uninterrupted, suitable for your specific purpose, or produce exact paint colour matches.

Limitation of liability

To the fullest extent permitted by law, Paint Element Pty Ltd is not liable for any indirect, incidental, special, consequential, or loss-of-profit damages arising from your use of the service. Nothing in these Terms limits liability that cannot legally be excluded.

Intellectual property

The Paint Element platform, software, branding, design, visualisations, workflows and related content remain the property of Paint Element Pty Ltd or its licensors. You must not copy, reverse engineer, resell, or misuse the service except as expressly permitted by these Terms.

Account termination

We may suspend or terminate accounts that breach these Terms, misuse the service, fail to pay subscription fees, or engage in unlawful or harmful activity. You may stop using the service at any time.

Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other laws that cannot be excluded, restricted or modified by agreement.

Changes to these terms

We may update these Terms from time to time. Continued use of the service after changes are published constitutes acceptance of the updated Terms.
